legal question

I got a pm from a board member asking if I would ship my AK that is for sale to NY. Is this legal?

I don't know NY laws but if you ship it to an 01 dealer the dealer is on the hook for not transferring an illegal firearm.

 Is it  legal for an 01  to Recieve a  new firearm From the Zastava factory in the former Yugoslavia (If the destructive device has been removed ?/?/

It depends.  The Feds will not allow the M59/66 to be imported.  They might allow other of the firearms to be imported if we don't have some kind of embargo against Yugoslavia/Serbia/Whatever.  In any case the dealer would have to apply for an import license/certificate before he could do the import and most won't do it.  It's a lot of work to become an "arms dealer" and the average 01FFL isn't going to do it.

The Feds will not allow the M59/66 to be imported.

Older rifles are importable under C&R rules, but newer ones are not.  ATF's C&R list contains the following entry:  "Yugoslavian manufactured rifles M59 and M59/66, 7.62 x 39mm caliber, all semiautomatic variations and having a fixed magazine, manufactured from 1947 to 1992."

They might allow other of the firearms to be imported if we don't have some kind of embargo against Yugoslavia/Serbia/Whatever.

"e-CFR Data is current as of June 15, 2007" . . . "It is the policy of the United States to deny licenses and other approvals with respect to defense articles and defense services originating in certain countries or areas ... IIRC, there was a change in Yugoslavia's status in early 2007.
