Rules Concerning the Posting of Items For Sale

 Due to the recent outbreak of '10 post spammers' joining and posting to fullfill a minimum of 10 post for the sole purpose of posting items for sale here at Survivors SKS Forum in the Classified Section it is with much regret that the Moderators and Administrators must change this minimum post count to rather reflect on Member Groups.

The fact is that many of the 10 post wonders have attributed to a heightened level of anxiety among both the members and staff.   Further, these boards were never intended to be a place for commerce in firearms.  There are excellent sites for such things, including Guns America and Gunbroker.  The For Sale forums are intended to be a convenience for established members to buy and sell firearms between themselves, NOT for the "general public" to register in order to have yet another place to sell firearms.

Posted below is what is called Member Groups. As members gain status up the ladder their Member Group changes which allow them to view and then post in the Classified Section.
 
Member Groups
Newbie = Invisible
Plinker = Invisible
Shooter = Invisible
Marksman and above = Full Access including starting new threads.


 NEW MEMBERS: WHAT THIS MEANS IS THAT YOU CAN NOT POST ITEMS FOR SALE OR TO BUY IN THE CLASSIFIED SECTION UNTIL YOUR MEMBER LEVEL SUPPORTS SUCH ACTIVITY. UNTIL THEN , YOU SIMPLY WILL NOT BE ABLE TO USE THAT SECTION.

Posting items for sale or as a "want to buy" ANYWHERE by those that have not achieved the status level allowing them to post in the area known as The Classified Section on the boards will not be tolerated and the post will immediately be removed. The excuse of not having knowledge of this rule is No Excuse and at the discretion of the staff the member that originated the post will either be warned or have their account suspended.

Any member who commits to buy or sell using the forum as a medium and then reneges on the transaction, i.e., breaches the contract of sale, may be warned, have their post count reset to zero, or have their account suspended.

 Guidelines for Classifieds:

1.   Caveat Emptor - Survivor's SKS Board is not responsible for the quality or condition of the property purchased within this forum.  All transactions are the sole responsibility of the buyer and seller. (Check the "Feedback Forum" before committing to buy from or sell to someone.)

2. This is not an auction site so please post your asking price for the items you wish to sell. To avoid unnecessary inquiries, you should also post payment options and shipping information.  If you are posting a package of multiple items for sale, please make it clear whether you are willing to break up the package.

3. If someone posts something and you think the price is too high, then don't buy it (or make a counter-offer). Flaming and trolling will not be tolerated. Please limit feedback to the "Feedback Forum".

4. Good taste dictates that negotiations be carried on via private message or email.

5. Please leave feedback on your transactions in the "Feedback Forum".

6. "I will take it rule" – Preference will be given to buyers who post “I will take it” when wanting to buy an item. When using this rule, any buyer will clearly state what it is he wants. Buyers posting other comment like “e-mail sent”, “offer sent”, “PM inbound” and not using the phrase “I will take it” should not be given priority if a later poster uses the “I will take it” rule. Sellers should make all reasonable efforts to accommodate “I will take it” buyers.

7. If you still have items for sale in your original post and it drops off of the page please feel free to "bump" it back up. There is no need to bump post that have not dropped off of the page.

8. The boards are NOT concerned with PRIVATE conversations but immediately upon conclusion of the private negotiations the seller should post SOLD.


Please note:

The EXACT words, "I will take it." are important.  In order for a contract to exist there must be an offer and an UNQUALIFIED acceptance.  There is no "I will take it if....." or "Great deal, I want it." 

For the legal eagles out there, ANYTHING but a completely unqualified acceptance is a counter offer and it is then up to the seller to accept or reject the counter offer.  Anyone who is experienced in negotiating understands that each and every response to an offer or counter-offer voids completely all prior offers.  Needless to say it can get very complicated in some situations. 

Potential buyers must understand that if they make a counter offer and begin negotiations the seller is not obligated to hold the item and anyone who comes along and says "I will take it" can do so, completing a contract even while negotiations are underway.  The reason for this is because if negotiations are underway there is nothing that binds either party and the negotiations may well end in a "no deal" situation. 

Finally, the Administrators and Moderators are not involved in any way in any contract that uses the boards as a communications medium.  Just as the telephone company is not a party to a contract negotiated over the phone, this site is not a party IN ANY WAY to the sales contracts of members or guests.  We have tried ONLY to establish guidelines that will, hopefully, make such transactions go smoothly but the boards will not sanction members other than to provide the feedback forum which may be used at will.

 90 Day Expiration Date on All Classified Threads

Threads older than 90 days will be deleted from all Classified Sections. YOU are responsible for maintaining YOUR thread. If you wish to have your thread active for over 90 days, bump it per board rules. If you have no more need of your thread, please mark your threads Closed/Sold/Traded/SPF etc, per board rules.

Bump Rule

If your thread is over 30 days old AND off the first page of the respective section, you may bump your thread. Those found to use excessive bumping, and/or useless chatter construed as bumping, will receive a bump on the head from the banhammer.

Thee exact words "I will take it" posted in the thread (not email, not PM, not Facebook, text message, etc) is the deciding factor as to who gets the item for sale. If there is three, four individuals negotiating with the seller, and someone posts "I will take it". The "I will take it" poster has accepted the sellers offer as it stands. The "I will take it" poster wins the sale and is obligated to send funds. An "I will take it" post does NOT entitle a persective buyer to stake "dibs" on the sale, then proceed to negotiate with the seller. "I will take it" trumps. If you post "I will take it", you bought the item, and you are now expected to send funds and shipping info.
