SBRing Your Imported Pistol...922(r) considerations
« on: May 19, 2023, 06:29:23 PM »
Basic ATF info on this subject from "stabilizing brace rule":  https://www.atf.gov/firearms/qa/i-possess-pistol-which-was-imported-and-then-subsequently-equipped-stabilizing-brace#:~:text=Does%2018%20U.S.C.-,%C2%A7%20922(r)%20apply%20to%20my%20firearm%3F,that%20is%20otherwise%20not%20importable.

Read it carefully . . . "no modification of such firearm would cure the 922(r) violation because the “assembly” has already occurred."  So apparently you're hosed.  I'm not sure I would want to submit an imported pistol with a brace for "amnesty", as it might involve submitting proof that you committed such a violation.  At least I would want to correct any alleged issues, as then it would be difficult for them to prove you actually assembled it in violation of the law . . . unless you posted photos of yourself and you're braced pistol all over the place and bragged about the lack of compliance parts.

And for those of us who missed the fact that ATF changed their mind on whether 922(r) applied to NFA items:  https://johnpierceesq.com/does-922r-apply-when-building-an-sbr-from-an-imported-pistol/.

PS:  This is a PSA for folks on this board, so don't get on my case.

This is the exact reason I sold all my firearms, it’s just to damn hard to figure all this crap out.

Well that's better than mine . . . they all went overboard when the boat overturned earlier this year . . .

Yeah, sadly I lost all mine when the Intex inflatable 2 man raft I paid cash for at the flea market popped while white water rafting in class V rapids on the Upper Gauley at Pillow Rock... Man, I'm lucky to be alive!

I remember that day.  There were several of us there comparing our collections on the boat when that damn rogue wave hit and left us all empty handed.  I can't remember exactly who was there as I was too shocked by the day's events, but I remember it was several members of this board.  I'm sure they'll all chime in soon.

Hilarity aside . . . back to our regularly scheduled programming:

In most places there is no such thing as a "pistol brace".  So for 922(r) purposes, your brace may be US-made.  I found this site:  https://www.dirtyjdesigns.com/collections/for-sb-tactical-braces.  They sell "plugs" for pistol braces, which help your brace to be more like the stock ATF already thinks it is.
