"Intent to go armed"
« on: May 12, 2010, 01:30:44 PM »
I have a question about the "Intent to go armed" law.

From Tn Laws http://www.nraila.org/statelawpdfs/tnSL.pdf

"It is unlawful for any person to carry “with the
intent to go armed” a firearm, knife with a blade
length exceeding four inches, or a club. The burden
is on the state to show an “intent to go armed.”"

next it says:

"It is a defense to unlawful carrying if the possession
or carrying was:
• Incident to lawful hunting, trapping, fishing,
camping, sport shooting or other lawful activity;"

Would going to the range not constitute "Shooting Sport or other lawful activity"?

I used to just put my unloaded guns in the car and ammo in the trunk, so I never had to think about this too much.

But now I have a regular cab truck. But neither the guns or the ammo is going in the bed so they can roll around, and I take too much ammo with me to lock it in the glovebox or something so how does one satisfy "Ammo not in general vicinity"?

Would putting the guns behind the seat and the ammo in the floorboard work? There's no way I would be able to reach behind the seat, take a gun out of a case, get to ammo and load a weapon while in the drivers seat but as usual when dealing with BATF I haven't found specifics.

You should probably consider purchasing a toolbox for your truck bed.  Either that, or else get a CC permit.

A tool box is the plan when I can, but I was hoping to be able to go in the next few days

What I'd do is put the rifles/handguns behind the seat then get a STEEL tool box with a padlock hasp and secure the ammo in that(or modify an ammo can with a lock hasp).  You can get a decent 20-24" steel box from Wal-mart for around $20.  Plastic would work, too, but might not hold up in an impact.

I dont see where it could be anything but legal based solely on what you posted.

There are provisions for "transporting" a firearm to and from activities where it is legal to use it. Your "intent" is not to be armed in case a conflict arises.

If it is not loaded, and the rifle/pistol is in a carrying case, and the ammo is secured in a box (even the same box I wold think) and you are headed to the range you should be legal all the way without a doubt. I personally in your case would put everything in a pistol/rifle carrying case, behind the seat, and call it a trip to the range.  I would not use spare mags to carry ammo though. I would keep the ammo in its own box, inside the range box or whatever.

Or get a carry permit :D

I am glad I live in Utah. They passed this bill in late 2009. "House Bill 357 removes the previous restriction against loaded firearms in vehicles without a concealed carry permit. The new law allows for anyone 18 years or older in legal possession of a firearm to have it loaded in a vehicle with or without a concealed carry permit. This new law effectively extends all firearm rights as they exist in the home to one’s vehicle."

Texas has that law also with some qualifiers. 1st one is you must be legally able to own a gun. It also has to be out of sight. Like the bad guys will follow the laws. Marcus

Strangely, GA prefers it loaded and in FULL sight if you are not a GFL holder (our version of a CCL). It can be loaded, and within reach, but needs to be visible to an officer if they walk up to the vehicle I gather
